Booth Space Rental Agreement Description:

This agreement is with Flea Market vendors at the Newport Antique Auto Hill Climb Festival Weekend which is the first Sunday in the month of October and the Friday and Saturday before. All vendors are independent operators, acceptance of their operators and operation is at the sole discretion of the Newport Lions Club. The vendors agree that the Newport Lions Club may revoke this agreement at any time and for any reason. Non-compliance of the rules as outlined in this agreement or in further notices will result in the removal of a vendor with no refund.

Contracted Booth Space and Size - Booth spaces are 10 feet by 18 feet. The Newport Lions Club will assign a booth space to each applicant whose application is accepted. Your booth space must remain at the assigned location throughout the event. Booth spaces are assigned at the sole discretion of the Newport Lions Club and are not transferable. A vendor forfeits his or her booth space upon termination of this agreement by either party, and may not transfer it to a third party.

Equipment and Utilities - This agreement is for booth space rental only, and the Newport Lions Club does not supply any equipment which may be necessary for the operation of vendor’s space. Electric service, extension cords, tables and/or chairs must be provided by the vendor, if needed for his or her operation. The Newport Lions Club will not be responsible for manpower to place trailers and equipment.

Parking - Does not guarantee parking for motor-homes, campers, cars, trucks, trailers, or other vehicles.

Security - The Newport Lions Club will provide limited security coverage in all festival areas after hours. However, the Newport Lions Club will not be responsible for any equipment left on the festival site after tear down, nor is it responsible for lost, stolen, or damaged items, equipment, etc. The Newport Lions Club is not responsible for accidents.

Determination - All matters regarding compliance with or violation of the above rules and regulations will be determined by the Flea Market chairman, with the assistance of the Executive Committee of the Newport Lions Club, and all decisions are final. Fire and Emergency Lanes - Fire and emergency lanes on all streets must be kept clear and maintained at all times.

Setup and Dismantle Times - Temporary structures must be weighted and there will no ground anchoring. Vendor setup will start on or after 12:00 p.m. the Friday before the Hill Climb and upon approval of the Flea Market chairman. Booth space displays must not be dismantled before the end of the Festival Weekend Sunday evening. Vendors dismantling displays or leaving before the end of the Festival Weekend will be considered to be in violation and will not be invited back for future engagements.

Clean Up - It is the responsibility of each contracted vendor to clean up around the contracted booth area on a continual basis (including tear down of boxes) throughout the duration of the festival and before departure Sunday to dispose in appropriate containers provided by the Newport Lions Club. Vendors will be billed for dump charges if trash is placed in private dumpsters. Trash barrels around booth spaces must be emptied by the vendors when they are full during open hours of the festival.

Contracted Booth Space Display - Other than free-standing or oversized items meant to be placed on the ground for normal use, all merchandise including boxes being displayed and/or offered or for sale must be displayed from tables, stands or in an appropriate off the ground manner. Crate displays are not approved. Vendors violating this provision will be removed from the festival with no refund and will be barred from future festivals.

Contracted Booth Space Access - Vendors may drive vehicles to booth space location during the setup and dismantling of displays, however no vehicles are to be left in the Booth space area after the event opens. Vehicles will only be allowed into town to restock booth space(s) between 11 p.m. and 8:00 a.m. Saturday and Sunday.

Contracted Booth Space Vendor Parking - Vendors will be provided with a parking pass to allow them admission without charge onto the parking area at the west end of town. All vehicles must be parked off street (preferably in the parking lot). Preferably in the parking lot, or will be subject to tow. Any vehicle parked on the street, in alleys, or in public right-of-way during festival hours will be towed at owner’s expense.

Prohibited Items - The Newport Lions Club, Newport Antique Auto Hill Climb and the Town of Newport specifically prohibit the following items from being sold during the festival: Pornographic material of any kind, drugs or drug paraphernalia, live animals, guns, swords, blowguns, and knives (other than folding pocket knives as defined by the state of Indiana statue). Violation of this regulation will result in removal of the vendor from the festival with no refund due.

Contracted Booth Space(s) Rental - Reservations are required and must be received by June 7th. Vendors will be charged $50.00 for each booth space for the Festival Weekend. This is a non-refundable reservation and booth space(s) rental fee.

Transient Merchant License (TML) - Professional and not-for-profit vendors will be required to register with the Town of Newport and obtain a 7th. Vendors will be charged $20.00 Transient Merchant License from the town. Not-for-profit vendors must fill out the application and obtain the permit, but are exempted from paying the license fee. TML License must be displayed at the booth space(s) so as to be visible from the street. It will be the responsibility of the vendor to satisfy all requirements for the Newport Town TML ordinance. The Newport Lions Club is not responsible for vendors who do not obtain permits and no refund will be issued by the Newport Lions Club if permits are not obtained or denied. Vendors will be individually responsible for compliance with the Town of Newport’s Transient Merchant Ordinance, and with any applicable State Law and Department of Revenue regulations.

Payments - The Booth Space rental fee is due at the time of application. TML applications and fees must also accompany this application when returned, or the application will be rejected. Vendors must check in to pick up their TML from the Town of Newport as well as their contract for next year, before setup. A Returned Check Fee of $25.00 will be assessed and the vendor barred from future festivals for returned checks. Failure to respond for payment within stated time line will result in a criminal action for Check Deception.

Release and Indemnification - Each vendor shall agree to release and hold harmless the Newport Lions Club, Newport Antique Auto Hill Climb and Town of Newport from any and all claims in any way arising from any and all injuries, losses, and damages to person and property sustained or received by any person as a result of vendors participation in the Newport Antique Auto Hill Climb. Vendors also agree to indemnify the Newport Lions Club, Newport Antique Auto Hill Climb and the Town of Newport of and from any and all expense arising because of any claim which may hereafter be presented by any one for losses and damage or personal injury as a result of vendors participation in the Newport Antique Auto Hill Climb.

Arrival Check In and License Pick Up - Flea Market Vendors shall check in at the Hill Climb Office upon arrival. Your TML license must be picked up before you will be allowed to set up your business. They will be available for pick up on Friday, the first day of the festival. This will complete the registration process.
